The investigation into the death of 29-year-old Scarlett Faulkner has moved beyond initial charges and into a period of intensive legal and forensic scrutiny. The Director of Public Prosecutions (DPP) is now reviewing a complete evidence file that will determine whether the original allegations are upgraded to reflect the fatal outcome.

Ms Faulkner died on April 13, nearly three weeks after the alleged incident on the R494 road at Birdhill, County Tipperary. Her death has transformed the legal landscape of the case. Legal observers widely expect the DPP to consider charges of murder or manslaughter, though no formal direction has yet been issued.

Forensic Evidence at the Centre of DPP Review

The post-mortem examination has been completed, and its findings are now central to the DPP's deliberations. Forensic investigators are also mapping the precise nature of the injuries sustained by Ms Faulkner, which the court has previously heard included eleven significant blows.

High-definition dash-cam footage and CCTV recordings from the R494 route form part of the evidence file. These recordings are understood to capture the moment a blue Volkswagen Touran intercepted Ms Faulkner's vehicle before the alleged assault. Gardaí have also expanded their timeline to examine the 24 hours preceding the incident. The court has previously heard allegations that those involved had searched for Ms Faulkner before the final confrontation. These remain allegations at this stage.

Teenager Remains in Oberstown as Psychological Assessment Proceeds

The 16-year-old female defendant, who cannot be identified due to automatic reporting restrictions under the Children Act 2001, remains detained at Oberstown Children Detention Campus in Dublin.

A state-mandated psychological assessment is currently under way. Judge Marie Keane granted the application for this assessment at a previous sitting and directed that the assessor be identified by the next hearing. The findings will examine the teenager's capacity to form criminal intent and her fitness to plead. No bail application is pending; the teenager appeared via video-link at the last hearing and consented to her continued detention.

Adult Defendant Remains in Limerick Prison

The woman in her 40s, charged with four offences including violent disorder and reckless endangerment, is being held at Limerick Prison. Her legal team, led by solicitor Padraig Nesbitt, has consented to previous adjournments.

When the case returns to Nenagh District Court on April 23, several outcomes are possible. The DPP may issue formal directions on whether charges should be upgraded. The prosecution may seek to have the case sent forward to the Circuit Court or, in the event of murder charges, to the Central Criminal Court.

Defence teams are expected to request full disclosure of all remaining evidence, including unredacted video footage. The reporting restrictions protecting the identity of the teenage defendant will remain in place unless a higher court orders otherwise.

Public Reaction and Community Mourning

The community of North Tipperary has continued to mourn Ms Faulkner, a mother remembered at recent gatherings including a balloon release in Limerick featuring purple and gold – colours chosen by her family. One close associate, speaking to a journalist during the funeral proceedings, said: "She was a mother, a sister and a daughter whose life was cut short in broad daylight."

Separately, Senator Sharon Keogan has publicly called for systemic changes following the incident, though her comments are not evidence in the criminal case and carry no weight before the court.

What Happens Next

The immediate future of this case rests on two pillars: the DPP's formal direction and the completed psychological assessment of the teenage defendant. If the DPP directs that the original charges stand, the case may proceed through the District Court. If a direction for murder or manslaughter is issued, the case will be transferred to a higher court with broader sentencing powers.

The next public hearing is scheduled for April 23 at Nenagh District Court. Until then, both defendants remain in custody, and the presumption of innocence applies in full.
