Twenty-four days after a pre-dawn petrol bombing killed four members of Waterford family, the death toll in the Birchwood arson has risen to five, two suspects remain in custody on non-fatal charges, and the alleged ringleaders of the attack have not been apprehended or charged with murder. Six-year-old Elliot English died at Children’s Health Ireland at Crumlin on Friday, 6 November 2026, following the attack on 7 Birch Avenue in the Birchwood estate shortly after 5:00 am on Tuesday, 13 October 2026. His parents, Philip English, 58, and Kim English, 38, and his brothers, Callum, 12, and Jayden, 9, were pronounced dead earlier. A fourteen-year-old girl remains under specialist care. An Garda Síochána has not charged any individual with murder in connection with the five deaths.

Daily Dazzling Dawn understands that the only two people in custody in connection with the fatal fire are Jessica Dalton, 31, with an address in Waterford city, and Cian Stacey, 21, of no fixed abode. Both were charged at a special sitting of Clonmel District Court with one count of criminal damage and two counts of Section 4 assault causing serious harm under the Non-Fatal Offences Against the Person Act 1997. They were remanded in custody and are due to appear before Waterford District Court by video-link on 17 November 2026. Neither has been charged with murder. Four other people arrested under Section 50 of the Criminal Justice Act 2007 were released without charge between 24 and 25 October, with files sent to the Director of Public Prosecutions.

The principal investigative focus remains on a family-based drugs syndicate allegedly directed by three brothers. Armed searches were carried out at the homes of each brother; one was not present, and gardaí have not publicly confirmed his whereabouts. No murder charge has been brought against any of the three. Daily Dazzling Dawn understands that senior investigators are also examining whether a Spain-based organised crime figure directed up to six separate arson attacks across Waterford over an eighteen-month period. Those suspected connections remain investigative assessments and have not been tested in court. A local neighbour told Daily Dazzling Dawn that Philip and Kim English had no involvement in drugs and that the couple and their children were entirely innocent. Gardaí have consistently stated that the family had no involvement in criminality.

The most significant development in the five-murder inquiry is its widening geographical and forensic reach. Seven searches across Waterford city have resulted in vehicles, mobile phones and laptops being seized for examination. Garda Commissioner Justin Kelly told a public meeting of the Policing and Community Safety Authority in County Cavan on 29 October that every available resource had been committed to the murder investigation and that further arrests were anticipated. He also disclosed that petrol-bomb attacks occurred elsewhere in the country on the two consecutive days after 13 October, underlining the wider pattern of drug-debt intimidation that investigators are attempting to dismantle. The inquiry, led by the Serious Crime Unit at Waterford Garda Station with support from the Garda National Bureau of Criminal Investigation, remains open.

John James English, the adult son of Philip English, has publicly stated that he has not been assigned a Garda Family Liaison Officer, unlike other bereaved relatives, and has urged gardaí to contact him. Daily Dazzling Dawn learned that he had previously complied with a Garda request to refrain from online commentary while operational inquiries progressed. He has vowed that the deaths “won’t be swept under the carpet either”. His public statements also confirm that Philip English saved the two younger children before succumbing to the fire.

The case returns to Waterford District Court on 17 November, when Dalton and Stacey will appear by video-link. The Director of Public Prosecutions is examining files on the four released individuals. Gardaí continue to appeal for dashcam footage and witness information from Birch Avenue between 4:30 am and 5:30 am on 13 October 2026 via Waterford Garda Station on 051 305300 or the Garda Confidential Line on 1800 666 111. Twenty-four days after the attack, five members of one family have died, two suspects sit in custody on non-fatal charges, and the alleged architects of the arson have yet to face a murder charge. Individuals before the courts are presumed innocent unless proven otherwise.
